An Act To Protect Minors from Pharmaceutical Marketing Practices

Summary
Senator Schneider of Penobscot is sponsoring the 2010 version of a controversial law enacted in 2009 to regulate the obtaining of information from teenagers. A federal judge and the Maine attorney general have indicated that the original law (LD 1183) was too broad and vague, and suggested that it be repealed and replaced by a measure more narrowly focused. Thus, LD 1677 would prohibit the collection of personal information on the Internet from teens for purposes of pharmaceutical marketing.
Position
This is a Maine Merchants Association priority issue. As noted above, the original law (LD 1183) was likely unconstitutional.
We do urge to swift repeal of LD 1183.
UPDATE 3-30-10: Governor Baldacci has signed LD 1677. The Repeal of LD 1183 is effective immediately.
UPDATE 3-19-10: The bill is currently working its way through the Senate. We expect it to be in the House next week.
UPDATE 3-11-10: The BRED Committee voted unanimously on Thursday to support an amended version of LD 1677 which strips out all the new language and simply repeals LD 1183. Once through the House and Senate and signed by the Governor, the repeal will become effective. This is a major victory for the members of the Maine Merchants Association.
UPDATE 3-9-10: The latest amendment is posted on the right which adds the language requested by Maine Merchants Association and our retail pharmacy members. Issue tabled until 3-11-10.
UPDATE, 3-5-10: The Maine Merchants Association testified in support of both LD 1677 as drafted with minor concerns as well as the amended version of LD 1677 with the same minor concerns. Both versions take into consideration the concerns of our members. Our minor concerns related to retail pharmacy and how they handle routine patient care matters.
